MESSAGE FROM ATTORNEY COOK

When a family is looking to engage a family law attorney, it is often because they are facing difficult circumstances and/or tough choices.  I have always appreciated that each family’s story is unique, and that the outcome of each case holds significant impacts on the client and their family.  Therefore, I offer free initial consultations because it gives me the opportunity to listen to the client and to learn about the challenges facing them.  I always tell clients that this is their life, and it is my job to help them see the options that are available to them and to explain the benefits and risks of each path that lies ahead.
It is always helpful for new clients to either bring all relevant documents with them, or even better to send them to our office prior to their initial consultation.  That way, I can review first-hand what has occurred and be better positioned to explain to the client what options are available to them. 
Another outcome of the free consultation is that the new client gets to meet me and listen to my evaluation of their case and/or situation.  From there, we can develop a path forward together that considers the client’s key concerns while understanding what risks may lie ahead. 
Divorce: This is so often a traumatic time for the client and their family.  It is common to feel overwhelmed, confused about what is happening, and angry about what you cannot control.   I have significant experience in working with clients through this process.  This allows me to share with the client what to expect in the near term and throughout the divorce in regards to the children, living situations, finances, property, taxes, retirements and pensions, and the other multitude of concerns that need to be addressed.  Then, the client and I can chart a direction together that best positions them throughout the divorce and ensures that their concerns are addressed.  If the other side is cooperative and fair, then we can work with them to come to a timely resolution.  If the other side is not playing fair, then I have the experience and disposition to get you to the best outcome available.    Modifications: It is the nature of life that things change.  Such change takes on new significance when it impacts or should impact those living under the guidance of court orders.  Promptly seeking a change to the current court orders may be in your best interest should a change in circumstances occur that results in increases or decreases in income, retirement, loss of employment, relocating, or changes in the behavior of another parent or spouse.  We can work together to make the decision that is right for you and ensure court orders protect and preserve what is important to you.  Enforcing Orders:  Orders exist so that both sides of an issue understand what to expect from the other.  A party failing or refusing to follow court orders should not benefit while the other party suffers.  You only have the rights that you stand up and demand.  I have experience in getting the other side to comply with orders, and we will work together to ensure that we hold them accountable for choosing not to comply. 
Child support:  Child support is calculated based on the gross weekly income of both parties.  It can be relatively straightforward if both parties are W-2 employees, but can more complicated if one or more are self-employed.  Child support can decrease if visitation approaches 50-50, or it can increase if one side has the children for less than one third of the time.  I have significant experience in locating income and assets from those that try to hide them.  I also have experience in creating relationships that help find agreements when others thought it was not possible.  We can work together to find the right path for you.    
Guardianships:  If you have an elderly family member that is unable to care for themselves, or if your family situation is such that a parent is unable or unwilling to care for a minor child, then a guardianship may be the right option.  I have significant experience in obtaining guardianships for adults in need and for minor children.  
Custody and visitation:  Nothing is more important that the health, safety, and well-being of your children.  It is in the best interest of the child or children for them to spend the right amount of time with each parent.  I have significant experience in obtaining fair custody orders where others could not, and in protecting children from parents that are unsafe, unreliable, or unfit.
